Next Tuesday, the amendment of the Ministry of Finance is being discussed in the plenary session of the Parliament, which provides for the possibility of the special administrator to terminate all the part-time employment contracts of the employees in LARCO. The amendment was submitted on Friday 10/6/22 to the bill for the reform of the Financial Stability Fund, which is scheduled to be discussed and put to a vote on Tuesday, 14/06/2022.
Specifically, Article 6 of the amendment amends / supplements the provisions regarding the “GENERAL MINING AND METALLURGICAL SOCIETE ANONYME LARCO” (LARCO GMMAE), which is under the status of special of Law 4664/2020.
In that case:
a. There is a possibility for the special manager to terminate all the part-time employment contracts of the employees in the company. As a consequence, the special administrator is assigned the determination of the amount of compensations due due to termination of employment contracts, for all employees and it is stipulated that the costs arising from the termination of employment contracts are covered by the Greek State (ED).
b. Similarly, the special manager is allowed to enter into monthly or bi-monthly fixed-term contracts for the period during which the special management operates, after the termination of the employment contracts and for the purpose of continuing the operation of the company and in each case up to five (5 ) months. It is stipulated that the costs arising from the conclusion of fixed-term contracts are covered by the E.D.
c. The integration of the dismissed employees in special actions, special employment programs, is the responsibility of the Ministry of Labor and Social Affairs.
According to the report of the General Accountant of the State, a relevant expenditure of approximately 31 million euros is foreseen, which is broken down into:
Approximately 24 million euros, from the payment of compensation due to the termination of all the part-time employment contracts of the employees in LARCO G.M.M.A.E.,
Approximately -7 million euros, from the conclusion of monthly or bi-monthly fixed-term contracts for the period that the special management operates, after the termination of the employment contracts and for the purpose of the continuation of the operation of LARCO G.M.M.A.E. .
The same amendment also provides for the granting of financial assistance, in the form of a direct grant, in the amount of up to nine million two hundred and twenty-four thousand (9,224,000) euros, to the company “Ellinair SA”, for the restoration of the directly related to the coronavirus pandemic. COVID-19 damage suffered. This expenditure is borne by the budget of the Ministry of Transport and Infrastructure.
