In the request made to the court, the lawyers of smoke claimed that he fulfills the requirements provided for in the law of criminal executions for the progression of the regime, including “good prison behavior”.
The man appointed as a “right-hand man” of Marco Willians Herbas Camacho, Marcola, the top leader of the faction, was transferred to the Federal Penitentiary System at the request of Ceará State Justice, where Fuminho responded to a process for double homicide.
He was denounced as the mastermind of the murders of Rogério Jeremiah of Simone, the mangrove Gege, and Fabiano Alves de Souza, Paca, executed in February 2018, in the Metropolitan Region of Fortaleza. At the time, the court considered that there was a risk of retaliation.
However, in April last year, the Court of Ceará considered that the prosecution was not proven and decided not to bring smoke to the popular jury.
With this, Frederico Botelho de Barros Viana, corregedor of the Federal Penitentiary of Brasilia, understood that “the reasons that led to the inclusion of the detainee in the Federal Penitentiary System no longer subsist in their entirety”. The decision also took into consideration a certificate of good prison conduct.
According to the decision, smoke should be transferred to a prison unit of maximum security in Aquiraz, in the metropolitan region of Fortaleza.
In the document, the magistrate made the caveat that “any court in which there is an arrest order against the prisoner may request the inclusion or maintenance of the detainee in the federal penitentiary system, provided that a new procedural incident is duly formalized.”
Who is smoke?
Fuminho is the main ally of Marco Willians Herbas Camacho, Marcola, in CCP’s international drug trafficking.
He fled the Carandiru jail in 1999 and was only recaptured 20 years later, being arrested by the Federal Police in Mozambique, in the African continent, in 2020.
Operation Mafiusi investigations found that at the time the CCP set up an operation valued at $ 2 million to rescue jail fum in Maputo, the capital of Mozambique.

Shortly thereafter, in March 2019, at the request of prosecutor Lincoln Gakiya, Marcola and the 21 leaders were transferred to federal prisons in Brasilia and Porto Velho.
