PEC dos Precatório is enacted in Congress

In a joint ceremony with the presidents of the Senate, Rodrigo Pacheco (PSD-MG), and the Chamber of Deputies, Arthur Lira (PP-AL), the enactment of parts of the PEC dos Precatórios was announced this Wednesday afternoon.

The announcement comes after an agreement between the two houses, announced on Tuesday night, to slice the agenda.

With the alliance, Congress enacts the common parts of the two houses, which includes the change in the correction of the spending ceiling and other provisions related to court orders, such as the correction index of amounts owed by Selic.

“All our effort for the promulgation of the consensual text is to support the social program. Perhaps, were it not for that reason, we would leave it for next year, with the necessary time. This logic belongs to all Senate leaders, there is a circumstance that is the fact that we are at the end of the year. Most of the leaders granted me this authorization and President Arthur Lira pledged that, once the consensus has been promulgated, he will set the agenda for next Tuesday, so that the Federal Senate’s innovations are voted on. Today we are enacting the PEC, identifying what is in common. There is a basic principle which is trust”, said Rodrigo Pacheco, after a complaint by lawmakers about the enactment of only parts of the text.

PEC of Precatório

The PEC opens up fiscal space of R$108.4 billion in the 2022 Budget, aiming to accommodate Brazil Aid. However, only R$ 64.9 billion of these resources will be guaranteed with the promulgation of the common text approved by the Chamber of Deputies and the Senate.

The other passages altered or inserted by the Senate in the text should be voted on on Tuesday (14) in the Chamber, where it needs 308 votes — since its text has been changed.

The measure was approved in two rounds last week in the Senate.

The space opened by the PEC of Precatório for expenses is distributed as follows:

• R$ 39.485 billion will be opened with the payment limit for court orders. These funds can be used for expenses related to social security, including the Auxílio Brasil income transfer program.
• R$ 4.08 billion will be opened with the precatório paid out of the limit. These resources have no restrictions on their use in the form of the Senate substitute.
• R$ 64.9 billion will be opened with the change in the calculation formula for updating the spending ceiling limits. This money can only be used for health, welfare and social assistance expenses, which also include the income program.
