The President of PEDMEDE, Mr. Michael Daktilidis, requested the withdrawal of the Draft Law of the Ministry of Infrastructure for the “model proposals for infrastructure projects” and its restoration with terms and provisions that will protect transparency, meritocracy and healthy competition. at the meeting of the Standing Committee of the Parliament on February 28, 2022.
During the meeting of the Standing Committee of the Parliament on 28.02.2022 on “Continuation of the elaboration and examination of the draft law of the Ministry of Infrastructure and Transport” Standard proposals for infrastructure projects and other provisions of the Ministry of Infrastructure and Transport “(hearing of non-parliamentary persons)” Mr. Michael Daktilidis, President of PEDMEDE expressed the views of the Union contributing to the work of the Commission.
The President of the Union, during his speech at the meeting of the Committee, pointed out, among other things: the State, to which many opaque assignments are attributed, allows for further arbitrariness and signals a lack of transparency, meritocracy and healthy competition. PEDMEDE intends to raise this issue through the FIEC (European Construction Industry Federation) social partner of the EU, in the competent Committees of the European Union.
The provisions of the Draft Law should also focus on the fact that small and medium-sized Contractors are in a very bad position, given that few projects related to their class are auctioned, while there is an over-concentration of large budget projects, which concern only the upper class. . Small and medium-sized enterprises could also be given more room for growth by planning and enforcing the tendering of smaller projects, as are the Community guidelines for supporting small and medium-sized enterprises.
The effectiveness of the new model of the Model Proposals is controversial, as clearly stated by EAADISY and the Competition Commission, as it does not apply in other European countries, except in “developing” countries (eg South America, etc.). In any case, the threshold of EUR 200 million in the budget of the proposed projects is unrealistic and should be adjusted to more realistic budgets, eg the threshold of the Community Directive.
In conclusion, the President of the Union stressed that the Draft Law should be withdrawn and returned with conditions and provisions that will protect transparency, meritocracy and healthy competition.
