The Attorney General’s Office asked the Federal Supreme Court to reject a crime news in which federal deputy Israel Batista (PSB-DF) asks for the investigation of Jair Bolsonaro (PL) after speeches about the fairness of the electoral process.
For the PGR, Bolsonaro’s comments are supported by the principle of freedom of expression.
“The ideological speeches of the President of the Republic are shielded by one of the first dimension rights, namely, freedom of expression. The penalization of expression is not the appropriate way to react to content with which one disagrees”, said Lindôra Maria Araujo, Deputy Attorney General of the Republic.
According to the PGR, the 1988 Constitution forbids political, ideological and artistic censorship, in addition to entrusting a democratic and dialogic society with the production of debates, criticisms, support and rejection of proposals in a dynamic process of circulation of ideas for the taking of a position by the people in the public arena.
“Whether or not one disagrees with the statements of the President of the Republic, it is certain that the subject addressed is the subject of public discussion, including within the National Congress, which rejected the aforementioned PEC. Evidently, positions in one sense or the other cannot be considered criminal, under penalty of curtailing the debate of ideas,” he said.
“The mere criticism of the electronic system and the pretension of its improvement do not lead, as the petitioner claims, to a “systematic attempt to embarrass the elections”.
For the parliamentarian, Bolsonaro is trying to jeopardize this year’s elections. In the piece filed with the STF, the congressman cited President Bolsonaro’s suggestion that the Armed Forces audit votes after the end of the elections.
“As if the content of what has been reported so far were not enough, Mr. President of the Republic even suggested suspending the elections and the electoral process this year,” he said.
