The Attorney General’s Office (PGR) defended, this Tuesday (14), that former football player Robinho serve a nine-year prison sentence in Brazil, imposed following a conviction by the Italian Court for the crime of rape.
The statement was signed by Deputy Attorney General of the Republic Carlos Frederico Santos and sent to the Superior Court of Justice (STJ). The Court analyzes a request from the Italian government for ratification in the country of the foreign conviction.
The measure was taken because Brazil does not extradite its citizens to serve sentences abroad.
In the document, Santos defends the possibility of transferring the sentence from Italy to Brazil, arguing that the procedure does not violate the Constitution and that there are decisions that support this possibility.
The deputy prosecutor also refuted the statements made by the former athlete’s lawyers, that there had been a restriction on the defense and that the ratification of the Italian conviction would represent an offense to national sovereignty, human dignity and public order during the criminal proceedings.
According to Santos, the analysis of the Italian government’s request does not require the entire foreign process to be assessed. The demand, which had been raised by Robinho’s defense, “exceeds the limits of indispensability for processing” the case.
For the PGR, by transferring the execution of the sentence from Italy to Brazil “the constitutional prohibition on the extradition of native Brazilians is respected while at the same time fulfilling the commitment to repress crime and legal cooperation in the criminal sphere assumed with the Requesting State”.
A CNN contacted Robinho’s defense, but there was no response until the publication of this report. The space remains open.
Robinho case
The STJ had already rejected a request made by Robinho’s defense for the Italian government to send the full and translated copy of the process that led to the former athlete’s conviction.
The former player’s defense argued that the documents provided so far are insufficient for the ratification of a foreign decision to occur – a process so that sentences produced abroad can take effect in Brazil.
Robinho received a nine-year prison sentence in December 2020 in the case that investigated sexual violence against a young woman of Albanian origin, in 2013. The case allegedly took place in a nightclub in Italy.
In January last year, the athlete had his conviction confirmed by the highest court in Italy. Almost a month later, on February 16, an international arrest warrant was issued.
The prosecution used audio recorded from a bug installed in a car, which captured a conversation between Robinho and his friends, which made it possible to confirm the victim’s version of the gang rape.
The defense handed over the former player’s passport to the STJ. He is prohibited from leaving Brazil.
