The Attorney General’s Office (PGR) spoke on Wednesday (07) in favor of the release of the Turkish-Brazilian citizen Mustafa Göktepe, arrested in April by decision of Minister Flávio Dino after Turkey asked for extradition.
The arrest was requested by the Turkish government, which accuses Göktepe of being part of the chain of command of an armed terrorist organization against the management of Recep Erdogan.
After a defense appeal, PGR stated that Göktepe has been naturalized Brazilian since 2012. The crime committed by it would have occurred in 2017, ie after naturalization. According to the Constitution, therefore, it cannot be extradited.
For the request for revocation of the arrest, the defense also said that the political scenario in Türkiye represents “serious risk of violation of human rights.” According to the lawyers, if Göktepe were extradited, he would not have “guarantees of independence and impartiality in the Turkish judicial system. ‘The arguments were accepted by PGR.
“The crimes that are imputed to him would have been committed on April 10, 2017, that is, in a period after the naturalization, which occurred in 2012, which is why the constitutional obstacle to extradition is incurred,” says the demonstration.
