In an interview with CNN This Tuesday (15), federal deputy Orlando Silva (PCdoB – SP) stated that digital platforms have an obligation to intervene in fake news and help in the fight against disinformation.
The Superior Electoral Court (TSE) signed an agreement with eight technology companies to prioritize official content. Representatives from Google, WhatsApp, Facebook, Instagram, YouTube, Twitter, TikTok, LinkedIn and Kwai were present at the ceremony.
Telegram, however, could not be reached by the Court to discuss the matter. Thus, TSE ministers expect some action from Congress before a possible legal action against the platform.
One possibility is the Fake News Bill (PL 2630), for which deputy Orlando Silva is the rapporteur. According to the deputy, the project is neutral from a technological point of view because it does not focus on any application. “The law must apply to everyone who works in this market,” he said.
Among the points of the PL is the creation of rules for content moderation (when the company/application removes a post, places a label or even suspends an account), a criminal offense to combat the spread of fake news on the internet and the requirement that companies have a legal representative and headquarters in Brazil, to facilitate contact with the country’s authorities.
According to the deputy, the main point of the text, however, is the possibility for the user to argue against the moderation of the content (such as an eventual suspension of the account).
Silva also explains that companies that do not comply with the law may face sanctions ranging from warnings, fines, suspension of service to blocking. The most severe measures, however, he warns, require a judicial measure and are not “exit measures”.
“At Big Techs don’t like any rules. When they are made, they are in contradiction to them”, said the deputy, citing cases from other countries that had difficulty regulating applications.
Still, he highlights the importance that platforms have in combating disinformation and, in this way, helping democracy.
During the interview, Orlando Silva said that the position of the president of the Chamber of Deputies, Arthur Lira, is to guide the project in March. Both will have a meeting in the early afternoon of this Tuesday with leaders of the benches to discuss the text.
“Important dialogue between House and Senate. My expectation is that in March we will have voted on a text that is in line with the Senate so that it can quickly vote on the text definitively”, he added.
