Police officers accused of death during Operation Shield will be tried by jury in SP

The military police officers who became defendants for the death of a man in a community in Guarujá, on the coast of São Paulo, during Operation Escudo will go to a jury trial.

Agents Eduardo de Freitas Araújo and Augusto Vinícius Santos de Oliveira are accused of shooting dead Rogério Andrade de Jesus on July 30, 2023.

Operation Shield left at least 28 people dead after the murder of ROTA soldier Patrick Bastos Reis.

According to the court ruling, the evidence that will lead the police to a jury trial includes images from the body cameras used by the officers. The material analyzed provides evidence that the officers were wearing a bulletproof vest, like the one found at the scene where the man was killed.

The police officers also allegedly failed to activate their body cameras during the incident.

“The images also show that, after shooting the victim Rogério, the defendant Eduardo advances into the shack and positions himself sideways, so that his body camera does not capture images of the victim. Then, the defendant Augusto enters the premises, but as his camera is completely obstructed, no images of the surroundings are captured,” says an excerpt from the court document.

The agents claim that the operation in Morro dos Macacos, in Guarujá, took place after local residents mentioned the presence of criminals in the neighborhood and “acted in self-defense”.

However, the decision points out that “the prior need to report armed criminals in the favela for the purposes of a police raid is doubtful, as it is public knowledge that poor communities in large urban centers are controlled by organized crime.”
