POMIDA: Letter to YPOIK for outstanding compensations of property owners from the reduction of rents

A letter to the political leadership of the Ministry of Finance and AADE was sent by POMIDA on the occasion of the recent decision A.1225 / 2021 of the Governor of AADE, which gives new deadlines for declarations of lessor real estate, which inevitably foreshadows and the constant protests of landlords and tax professionals from all over the country that their legally prescribed compensation has not been paid even though there is no formal omission on their part.

POMIDA points out the current pending issues, but also its proposals for the solution of individual problems that remain from the implementation of this process.

At the same time, POMIDA thanks the Governor of AADE, Mr. George Pitsilis, for the satisfaction of her request for the data and the VAT number of the lessee to be displayed in the application of the Lease Information Statements, facilitating substantially all those involved with the declarations.

However, he requests an extension of the deadline for declaring the solution of old leases at the same time with the addition of the option “Active Leases” in the relevant application, so that taxpayers are not threatened with unfair fines by undeclared solutions of old leases.

SUBJECT: Reduction of rents: Pending compensations of property owners.

Dear Messrs. Ministers, Mr. Commanders,

On the occasion of yesterday’s decision A.1225 / 2021 of the Governor of AADE, which gives new deadlines for declarations of landlords of subletted real estate, which inevitably foretells a new delay in the payment of compensation, but also the constant protests of the landlords country that their legally prescribed compensations have not been paid, although there is no formal omission on their part, we point out the following current issues, as well as our proposals for resolving individual problems that remain from the implementation of this procedure:

1. The liquidation must be completed and all the outstanding amounts of compensation of the last months must be paid, especially those related to real estate subletting. A necessary condition for the correction of Covid statements is that those involved are informed by AADE about the type of mistakes that everyone has made. The updates that have been posted so far are until April 2021 without giving a clear picture of how to resolve the errors. Especially in the cases of Leases, the landlords do not know to whom their tenant has sublet the property and whether the conditions of Ε.2123 / 2021 apply.

2. To open the application for submission of corrections and COVID declarations of the period March-October 2020, which is not only our constant request but also a moral obligation of the State towards the citizens who were wronged by the lack of information at that time.

3. To open the application for submitting COVID declarations for the months of June & July 2021 because for this period of time the opportunity was given only for initial declarations.

4. Immediately issue decisions for the KAD for the months of August and September 2021, or even announce that there is no longer any right to reduce rent, given that various tenants still refuse to pay their rents or part, with the unproven claim that continue to be entitled to rent reduction!

5. In the “Personalized Information” of the taxpayers who know that they are entitled to offset of last year’s compensation compensations from rent reductions from this year’s tax liabilities (income and ENFIA) there is no fully automatic offset! Therefore, the AADE platform must either show up immediately and deduct from the “Personalized Information” the amounts to be set off and the amount of tax payable, or at least an announcement must be issued immediately on the manner and time of automatic offsetting of last year. the new debts, before the expiration of all deadlines for payment of income installments and ENFIA!

On this occasion, we consider it our obligation to thank the Governor of AADE Mr. G. Pitsilis for the satisfaction of our request in the application of the Lease Information Statements to display the details and the TIN of the lessee that concerns each declaration, facilitating substantially all involved with these statements.

However, with regard to lease termination declarations, we again ask for an extension until the “Active Leases” option is added to the Lease application of AADE (with yellow color only for the initial and amendment lease declarations and not for the COVID declarations), before the automatic completion of Form E2 for the declaration of Leases is activated, so that the taxpayer can easily immediately find the already inactive leases and declare their termination without being subject to unjust fines for it.
