POMIDA to RIS: Extension of the drafting of contracts based on engineer certificates

POMIDA requests in a letter to RIS to extend the possibility of drawing up real estate transfer contracts based on engineer certificates until 31.12.2022, in order to facilitate the citizens in their transactions and not to paralyze the Real Estate Market.

At the same time, POMIDA requests that the arbitrary category 5 be allowed to be regulated within the above deadline, exclusively through the submission of an electronic building ID, unless a timely engineer certificate had already been issued for them.

SUBJECT: Extension of the drafting of contracts based on engineer certificates until 31.12.2022.

Honorable Ministers, Madam General, Madam President If any of you have lately had to engage in any capacity in a notarial transfer of property, you will surely find the “Golgotha” experienced by all the parties, and especially the sellers but also the parents or donors based on the new tax-free amount of € 800,000, from the endless pile of supporting documents and certificates required for the signing of the simplest contract, and the time-consuming procedures that must precede and follow for its completion.

It is a fact that lately significant steps have been taken to improve the situation in individual sectors, such as the electronic submission of VAT and donation declarations, the electronic receipt of cadastral excerpts, electronic insurance information, the platform for undeclared areas, etc .. However, many problems remain unsolved, such as the delay in the transfer of contracts, the issuance of TAP and other certificates, the requirement of forestry certificates even where the State does not have or claim property rights, the attachment of expensive topographies, etc., resulting in the time required for the preparation of any contract ranging from 3-6 months. After all, even many of the certificates that are supposed to be “issued electronically” are actually simply charged electronically to employees, who fail to respond in time to the volume of requests, resulting in these certificates being issued several weeks later.

It is therefore easy to understand what delay and chaos, suspension of transactions and destruction of the real estate market, to the detriment not only of the citizens, but also of the State itself will prevail, if from April 1 is added as a mandatory prerequisite the issuance of electronic building ID , which requires more supporting documents (permits, plans, floor plans, contracts, certificates, etc.) but also time, than all the prerequisites for signing a contract.

For these reasons we ask:

* To extend the possibility of drawing up real estate transfer contracts based on engineer certificates until 31.12.2022, in order to facilitate the citizens in their transactions and not to paralyze the Real Estate Market.

* To give the possibility of regulation within the above deadline of the arbitrary category 5 through exclusively the submission of the electronic identity of the building, unless a timely certificate of engineer had already been issued for them. ”
