Porsche driver becomes defendant for murder; Court denies arrest

The São Paulo Court accepted this Tuesday (30) the Public Ministry's complaint against businessman Fernando Sastre de Andrade Filho, 24 years old, who now becomes a defendant in the case.

The businessman was driving the Porsche which, in the early hours of March 31, hit a Renault Sandero and caused the death of app driver Ornaldo da Silva Viana, 52 years old. The case occurred in the east zone of São Paulo.

A CNN had access to the decision signed by judge Roberto Zanichelli Cintra, who denied the third request for preventive detention against the businessman.

The judge called the allegations presented by the Public Prosecutor's Office about the possibility that Fernando had broken precautionary measures for allegedly agreeing on his girlfriend's testimony an “unfounded illusion”.

In the document, the judge gave ten days for the businessman's defense to present itself in the process and requested the availability of the expert reports requested by the Public Prosecutor's Office.

In a previous statement, the São Paulo Public Ministry had requested that the process documentation be sent to the Military Justice Prosecutor's Office to investigate the role of the military police officers in the case.

The shipment was also denied, on the grounds that the PM was conducting its own investigation and had broad access to the details of the case. “I remind you that the Civil Police also established its own procedure to investigate the possible responsibilities of the employees who attended the scene of the events”, highlighted the magistrate.
