Porsche owner: Key witness says he drank with businessman before the accident that killed app driver

A witness who was with Fernando Sastre de Andrade Filho, aged 24, hours before the accident that killed the app driver, Ornaldo da Silva Viana, reported to the police that on the night of the incident he had had “a few drinks” with the businessman .

The woman gave a statement at the 30th Police District yesterday afternoon (3) and told investigators that she was with her boyfriend and that she met Fernando and his girlfriend for dinner in the Tatuapé neighborhood, East Zone of São Paulo.

The witness said that at the restaurant he had “a few drinks” with Fernando and that from there, they decided to go to the Poker House, where a party was taking place where entry cost R$300 and which was open bar. .

At the gambling house, the witness said that he was talking to the businessman's girlfriend and that he did not see Fernando drinking alcoholic beverages. The owner of the gaming house also gave a statement and said she was unable to indicate whether Fernando had been drinking.

The witness' report also describes that when they decided to leave, Fernando argued with his girlfriend, as she had asked him not to drive, as he was impaired. However, the businessman did not want anyone to drive his car, a Porsche Carrera, valued at R$1 million.

The argument was captured by surveillance cameras on the street where the Poker house operates and It only ended when Fernando's friend offered to go with him so that “he wouldn't do anything wrong”, according to the report.

High speed launch and version divergence

The witness interviewed yesterday afternoon also said that after leaving the gambling house, they walked slowly until, at a certain point, she noticed that Fernando took off with the car to the point where she, who was in another vehicle, lost sight of him.

A camera on the route shows that the car passed at a higher speed than the vehicles that were on the same road before the accident. In his statement, Fernando said he was only a little over the limit.

Also in testimony, Fernando denied that he had used drugs and consumed alcoholic beverages. But another witness to the accident, who helped rescue the victims, said that he appeared to be drunk and was staggering, in addition to having a “slurry” voice without knowing what was happening.

Moments after the collision, the businessman's mother removed him from the scene of the accident, claiming that she was taking her son to the hospital. However, the police did not find him and did not perform a breathalyzer test. In testimony, the woman said that she took medication and fell asleep before taking her son to the hospital.

What the defense says

In a statement released by Andrade Filho's defense, lawyers Carine Acardo Garcia and Merhy Daychoum state that the boy did not flee the scene of the accident.

“Since help was already being provided to the other victims, Fernando was already duly qualified by the military traffic police, having been released by the Military Police to be taken to the hospital. However, due to a well-founded fear of suffering lynching, since at that moment he began to suffer “virtual lynching”, as well as due to the shock caused by the accident and the news of the death of the driver of the other vehicle, his protection was necessary”, argues the defense.

Victim's son

Ornaldo da Silva Viana's son, Lucas Silva, spoke out on social media in protest over his father's death.

“The feeling I carry is one of deep sadness and anguish. A gigantic feeling of injustice inside me”, says Luam in a post. “A man like you didn’t deserve anything that happened.”
