The Rio Grande do Sul Civil Police indicted, on Thursday (15), lawyer Daniel Nardon, investigated by Crimes of counterfeiting of a private document, ideological falsehood and use of false document . The investigation began in January, from a news of fact sent by the Public Prosecution Service (MP).
The MP’s request was made for the purpose of investigating the practice of illicit in lawsuits filed in the name of people who have already died. The scheme is known as “predatory law” by the authorities.
Fernando Daniel Nardon had his precautionary suspension decreed by the president of the Brazilian Bar Association in Rio Grande do Sul (OAB/RS). The measure, according to the authority, aims to prevent the exercise of law due to the severity of the accusations being determined.
According to the investigations, Nardon would have filed a contract review lawsuits against a banking institution, using a power of attorney allegedly signed by a client who had died two months earlier.
Given the irregularity, the lawyer was summoned to provide clarification. In his justification, he claimed that at the time of the signature he was unaware of the customer’s death.
Nevertheless, the fraud was identified before the suspect obtained any economic benefit. During the demarches, the existence of several other processes with the same pattern of action was found, all filed in the District of Porto Alegre.
In addition, the child of the deceased client was heard and said he was unaware of the existence of revision actions, and did not recognize the signature contained in the documents presented.
Considering the accusations, the added penalties may range from three to 15 years in prison, as well as a fine.
