The defense of soldier Luan Felipe Alves Pereira, who was caught throwing a man off a bridge in the south of São Paulo, considered that the agent’s arrest only responded to a “social outcry”.
The agent was arrested this Thursday morning (5), while on duty at the Military Police Internal Affairs, in the central region of São Paulo. The soldier had been away from the streets, on administrative duties, since last Tuesday (3).
Lawyer Wanderley Alves, responsible for the soldier’s defense, stated that he has not yet had access to the full decision of the Military Justice Court (TJM) that determined the arrest. The defender states that he will file a request for the PM’s release.
“This arrest demonstrates that there is an anticipation of guilt. The police officer was at the disposal of the courts, and the preventive detention only responded to a social outcry, transforming a procedural arrest into a prison sentence”, he declared.
The lawyer argues that the prison does not meet legal requirements because the soldier has a fixed residence was working as determined, voluntarily presented himself to the Court and contributed to the investigation.
Police officer Luan Felipe Alves Pereira must undergo a criminal examination at the Legal Medical Institute (IML) and will then be taken to the Romão Gomes Military Prison, in the north of the capital.
In the decision that determined the arrest, the Military Court states that “preventive detention is essential to preserve discipline in the barracks, given the seriousness of the crimes investigated and the negative repercussions that the remaining person under investigation at liberty can generate among the troops.”
In addition to the soldier, 12 other agents involved in the incident were removed from the streets by the Public Security Secretariat (SSP).
According to the investigation, it is soldier Laun who appears in a video throwing a man into a stream, off a bridge, in the Vila Clara neighborhood, in the Cidade Ademar region. Luan and the other soldiers belong to the 24th Diadema Battalion.
The soldier has already been accused of the death of a suspect with 12 shots after a chase in Diadema, in Greater São Paulo. The case, which was initially processed in the Military Court, was sent to regular court on suspicion of intentional homicide, but ended up archived in January of this year.
This Wednesday (4), in an interview with CNN the general commander of the São Paulo Military Police, Colonel Cássio Araújo Freitas, stated that all episodes of police violence that occurred in recent days are under rigorous investigation by the corporation’s Internal Affairs Department.
