Processes for drugs for personal use have the lowest level in 5 years, says CNJ

Brazilian justice received the lowest number of new cases related to drug possession for personal use in the last 5 years, according to 2024 data from the National Council of Justice (CNJ).

Between the months of January and November, there were around 96,768 new cases of this type in courts across the country.

Compared to 2023, the number was much higher, with 147,998 new cases, an average of 405 per day, a number that fell, as in 2024, the average rose to 288 per day.

The drop is a reflection of the decision of the Federal Supreme Court (STF), which in June last year, defined a limit of 40 grams of marijuana or six female plants as a criterion to differentiate the user from the drug dealer, which ended up decriminalizing the use of marijuana. , being an illegal administrative act, and no longer a crime.

When committing an administrative offense, the person is subject to punishments such as warnings about the effects of drugs and educational measures such as attendance at courses.

At the time, the vote was taken by a majority of the Supreme Court ministers, with eight votes in favor (Gilmar Mendes (rapporteur), Edson Fachin, Luís Roberto Barroso, Alexandre de Moraes, Rosa Weber, Dias Toffoli, Luiz Fux and Cármen Lúcia), and three opposites (Cristiano Zanin, André Mendonça and Nunes Marques).
