Public consultation form was unsafe for users, says expert

In an interview with CNN, the director general of Open Knowledge Brasil, Fernanda Campagnucci, explained that the public consultation formulated by the Ministry of Health on childhood vaccination was unsafe for users for not following the precepts of the General Data Protection Law (LGPD).

According to the specialist, the consultation asked for data “beyond what is necessary”, such as phone number, gender and date of birth. Furthermore, the main problem, according to Campagnucci, is that there is no declaration of how this information will be used and specification of how it will be stored.

“We know that they would be being stored in a spreadsheet, in a very insecure way, it doesn’t have all the security mechanisms that would be necessary”, he added. “And, as the LGPD says, it is reasonable to collect the necessary information for that purpose”, he adds.

After instabilities on the platform and criticism that it would only be possible to collect 50,000 responses, the government migrated the survey to another site this Friday (24).

Campagnucci explains that the survey was also susceptible to voting using robots, as it was not specific to validate people’s identity.

As Campagnucci explained, there is still no privacy statement and “more than necessary” data is required. Thus, the correct tool would not be being used.

“What is known is that it was more than one form, so up to 100,000 people may have responded to this form in an insecure manner. These data were collected irregularly”, says the expert.

“The correct thing would be to delete the data [das primeiras pesquisas], to have risk mitigation with the collected data. We also have a problem with the reliability of these results, as there was no CPF validation and the same person could enter data more than once, there was no guarantee that a single person was voting”, he added.

Thus, the director-general also states that it would be possible to challenge the consultation in court, due to the way in which the information was collected, which is not adequate to the legislation, and also because of the research format.
