Public contracts linked to Covid in the Valencian Community will not be submitted to competition

 

Contracts made by the Generalitat Valenciana and that are linked to the fight against the coronavirus pandemic and reconstruction will not have to be submitted to public tender and may be awarded directly. This is what the 2021 Budget Accompaniment Law will include, which will include this express procedure at the request of the three Botanical groups that support the Consell, as confirmed by the President of the Generalitat, Ximo Puig.

This is a claim that Puig has made in the different Presidents’ Conferences that have been held in recent months and that will consider all the actions carried out with charges from the Covid reconstruction funds will be processed through the emergency procedure , according to the Public Sector Contract Law. In other words, bureaucratic procedures will be streamlined as the need to call public tenders will disappear and awards can be made directly.

“We are in a health emergency, an economic emergency and a social emergency. That is why it is essential that the response we give is also an emergency,” says Ximo Puig in relation to the amendment presented in Parliament, which will introduce a new additional provision in the law on Fiscal Measures, Administrative and Financial Management, and Organization of the Generalitat Valenciana.

“We need management, press the accelerator and mostly execute the actions of the repair plans between the years 2021 and 2023; and for this it is necessary to have more agile mechanisms to process the contracts,” adds the Head of Consell.

The Government of Spain has also announced the processing of a royal decree aimed at modifying the Law on Public Sector Contracts, the General Law on Subsidies and the Law on Administrative Procedure. “But it was necessary to have a similar procedure from the perspective of the Valencian Community,” insists Puig in a statement.

Under this new emergency procedure, the 400 actions included in the Valencian Recovery Strategy will be processed, which has a global budget of 21,000 million euros linked to the European funds, but also any contracting that the Generalitat needs to carry out and whose purpose is the fight against the pandemic, from the health, social or economic point of view. In fact, there are investments included in the Valencian budgets that would no longer have to go through a bidding process, but would be processed directly.
