Quentin Tarantino: “I have the right to sell scenes from Pulp Fiction in the form of NFT”

The filmmaker proves to the Miramax film company through the court that he owns the rights to the script, which means that he can launch non-collectible tokens in the form of episodes from the movie Pulp Fiction.

Quentin Tarantino is preparing to release collectible tokens in the form of scenes not included in the film company’s version of the version, a handwritten script and exclusive audio commentary by the director himself. However, Miramax filed a lawsuit against Tarantino, accusing him of copyright infringement on the film, the profit from which belongs to the film company.

Miramax insists that its rights extend even to technologies not yet created in 1996, when the agreement with Tarantino was concluded. The film company refers to the wording in the contract that it has all the rights that were in effect at that time or may appear in the future, as well as with regard to all media known at that time or that will appear later.

However, Quentin Tarantino’s defense is unwilling to give up. Lawyer Bryan Freedman argues that his client has the right to sell NFT with fragments of the work, because he owns the copyright to the film script. Tarantino’s agreement with Miramax provides that he has the right to release printed materials related to the film. This includes publishing scripts, creating books and comics, including audio and electronic formats, and other interactive publications.

The main NFT-related content consists of electronic copies of the uncensored first handwritten Pulp Fiction scripts, Friedman explained in a motion before the court. According to Friedman, the film’s script is an original, copyrighted work. The exclusive copyright for the script, including dialogue, characters, description of the plot and scenes, belongs to its author. The film, created according to the script, is only a derivative component.

Jeremy Goldman, a partner at law firm Frankfurt Kurnit Klein & Selz, believes NFTs can be used by both parties: Miramax for the film, Tarantino for the script. Miramax mentions the media, but NFTs are not considered the media, they are a kind of record of ownership, Goldman explained.

In 2022, sports brand Nike sued online reseller StockX for illegally selling NFTs in the form of sneakers sold by the company.
