RAE warning about misleading advertisements from electricity suppliers

RAE has detected misleading advertisements from Electricity Suppliers in relation to the subsidies for electricity bills granted by the State through the Energy Transition Fund and warns that on Thursday 4 August 2022 it will publish these cases on its website.

Specifically, the Authority states:

“Taking into account that the subsidy in question of consumers’ energy costs is financed by TEM resources, i.e. by state resources, and does not constitute a discount provided by the Suppliers, in the context of their commercial policy, it should have been self-evident that any reference, depiction or inclusion of the amount from the said government subsidy in the new invoices of the Suppliers must be clearly stated as coming from the State.

Unfortunately, however, very recent advertising and communication tactics of Electricity Providers are characterized by vagueness and inaccuracy as to the essential elements of what appears as a “reduction”, “discount” or alternative discount” of the Supply Charge, as they conceal that it is granted horizontally and equally to all consumers regardless of Supplier and instead present it as a commercial privilege of the particular supplier. In this regard, it is pointed out that such tactics are manifestly misleading, since they may give consumers a false impression of the Supplier’s pricing policy. Indeed, concealing the nature of the reduction – discount and/or its distorted or selective presentation erode the consumer’s right to free choice of supplier and supply product, after being properly and transparently informed.Furthermore, through this type of attractive tactics, some Suppliers may obtain half advantages, resulting in the disruption of healthy competition in the retail market. For the above reasons, these abusive practices grossly violate the existing framework.”

Moreover, RAE published today on its website the list of electricity tariffs announced yesterday by the suppliers and valid for the whole of August.
