Referral of Hungary to the European Court of Justice by the Commission for law release of illegal immigrants

The European Commission announced today that it has referred Hungary to the European Union court for a Hungarian law providing for the release of illegal immigrants in a new turn to the confrontation between Hungarian Prime Minister Victor Orban and Brussels. In April 2023, the Hungarian nationalist government adopted a decree that allowed the release of hundreds of people who had been convicted of trafficking in immigrants with the ultimate aim of expulsion. Budapest then argued that the measure was intended to dismantle prisons where hundreds of traffickers were held, and not to be burdened by Hungarian taxpayers. This decree was at the same time a way of questioning the European Union’s immigration policy. The measure has repeatedly been reported by the Commission, which states that there is no provision for monitoring the implementation of the detention of immigrants outside Hungary.
