In 2002, Robinho emerged as the main promise of Brazilian football. Skilled and full of achievements at the age of 17, the striker who began his career in the city where he was born, on the south coast of São Paulo, and has a history of football achievements and controversy in his personal life.
The Brazilian player was convicted in all instances of Italian justice, and the Milan Public Prosecutor’s Office appealed to Brazil, asking the country to extradite Robinho immediately. However, Brazilian legislation does not allow the extradition of citizens born to serve sentences in other countries.
The STJ decided to arrest Robinho to serve the 9-year sentence for the crime. The Special Court decided to ratify the Italian sentence in Brazilian territory, following a request from the Milan Public Prosecutor’s Office.

The crime occurred in an Italian nightclub, in 2013. At the time, Robinho played for Milan, in Italy.
During the investigations, Italian justice intercepted a series of telephone calls between the former athlete and friends, also accused and convicted of the same rape. In the recordings, Robinho and friends make fun of the situation, believing that they would be free from punishment.
According to investigations, Robinho and friends were at a nightclub in Milan, celebrating the birthday of one of them, when they met the victim. In one of the interceptions, Robinho says that the friends “snapped” the victim, in an act considered by the courts to be collective rape.
Robinho Prison
The former Brazilian national team player has been imprisoned in the interior of São Paulo since March 22, serving a 9-year prison sentence for a gang rape committed in Italy in 2013.
As Brazilian legislation does not allow the extradition of born citizens to serve sentences in other countries, the STJ decided to arrest Robinho here in Brazil to serve the sentence.
The Special Court of the Superior Court of Justice (STJ), decided that Robinho’s friend and also convicted of rape in Italy, Ricardo Falco, should serve his sentence in Brazil. He was arrested in São Paulo in June this year. According to the lawyer, Ricardo Falco and Robinho no longer have a friendly relationship, having separated shortly after the investigations began.
The request for habeas corpus made by Robinho’s defense is being analyzed by the STF. The Attorney General’s Office (PGR) expressed its rejection of an appeal by the former football player, questioning the calculation of the penalty for the rape conviction.
