The 59-year-old retired state public defender, accused by two delivery men of racial slur in a condominium in Niterói, Rio de Janeiro, already has at least five records with the Civil Police for the crime of slur.
According to information obtained by CNN , in one of the cases, in 2014, when she was still a defender, she would have referred to a health plan employee, using expressions such as “deaf”, “mute”, “unhappy”, in addition to saying that she “paid for her salary” . After the attacks, allegedly carried out over the phone, the woman went to the Civil Police station to file a report.
In addition to injury, the Civil Police of Rio de Janeiro has already received records against the defender for crimes such as bodily harm and embarrassment.
According to the police, the woman should be heard next week in an investigation that investigates the case of injury by prejudice.
According to the incident report carried out on Tuesday (3), the case began when Eduardo Peçanha and another colleague were delivering to a luxury condominium and parked a van in front of the former public defender’s garage. The woman, in turn, asked that the vehicle be removed from the entrance to the residence, which was not promptly answered by the delivery men.
Joab Gama de Souza, the victims’ lawyer, says that the wait for the vehicle to be removed lasted only a few minutes. He explains that the van driver made a delivery to a neighboring residence and, therefore, did not pick it up immediately. Also according to the lawyer, the delivery man who stayed in the vehicle did not have a driver’s license to remove him from the place, starting the discussion.
“The woman asked that the vehicle be removed from the garage. The assistant replied that he would have to wait for the driver to arrive, because he was not capable of driving. Soon after, she lost control and began to offend the workers. She called them both ‘monkeys’. Then she started throwing objects towards the van. We have registered a case and hope that the case will be assigned to a specialized police station,” she said. Joab Gama.
The case, which took place last Saturday (30), is also monitored by the Commission to Combat Discrimination and Prejudice of Race, Color, Ethnicity and Religion of the Legislative Assembly of Rio de Janeiro (Alerj). Through lawyer Daniel Vargas, the commission officiated at the Police Station for Racial Crimes and Crimes of Intolerance (Decradi), to join the investigation of the complaint.
THE CNN Daniel Vargas also confirmed that the former defender tried to break the vehicle’s rear view mirror before calling the employee a ‘monkey’.
In a note, the Public Defender’s Office of Rio de Janeiro reported that it is “absolutely opposed to any form of discrimination” and that it has coordinators active in these types of cases. The organ, finally, highlights that the woman in the video “has been retired since November 2016.”
In an official statement, the Civil Police said it had requested security camera footage for the investigation of the case.
On Thursday (5) a team from CNN went to the condominium where the retired defender lives, to hear her version.
At the request of the report, the doorman called her three times, but she said she would not like to talk about it. THE CNN has not yet been able to contact the defendant’s defense.
