Right to identify children and the biological mother’s partner approved the Italian Constitutional Court

Italy’s constitutional court issued a historical ruling, recognizing the full right to both members of the couples made up of homosexual women to recognize their children immediately after their birth. Although Italian legislation still does not allow access to medically assisted reproduction for homosexual couples and women or men without a partner, the court stressed that in the case of children born abroad through this procedure, it prevails the child’s interest. On the basis of the new decision, in addition to the biological mother, the right to recognize the child is also acquired by her partner, provided she has consent to the reproductive process. The judges emphasized that the prohibition to date created serious obstacles to children’s access to continuous care, education and general support from both their parents.
