Rio MP changes accusation against suspect of attacking Porta dos Fundos headquarters in 2019

The Public Ministry of Rio de Janeiro changed the complaint against economist Eduardo Richard Cerquise Fauzi, 41, accused of attacking the headquarters of the production company Porta dos Fundos, on December 24, 2019.

According to the new understanding of the prosecutors, Fauzi’s crime – detained since March 4 at the José Frederico Marques Prison, in Rio de Janeiro – changes from attempted murder to that of causing fire, much lighter with a sentence of up to six years. of seclusion.

For the crime of attempted murder the conviction can reach up to 30 years. The process is in the 35th Criminal Court of the Court of Justice of Rio de Janeiro and the judge will decide whether or not to accept the change request made by the MP.

The setback in the case is a consequence of the change in the process, which was in the Federal Court, in which Fauzi was a defendant for the crimes of terrorism and fire. The maximum penalty for terrorism is also 30 years.

However, in February, judge Marcello Ferreira de Souza Granado, of the Federal Court of Rio de Janeiro (TRF-2), ruled that Fauzi would no longer be charged with the crime of terrorism, as had been requested by the Federal Public Ministry (MPF).

The MPF appealed, but the appeal has not yet been judged. Thus, the case left the jurisdiction of the Federal Court and the case file returns to the Court of Justice of the State of Rio de Janeiro.

Back at the 3rd Criminal Court of the TJ do Rio, where the process had started, in January 2021, the magistrate’s new understanding, in March of that year, was that the economist’s attitude did not represent a willful crime against life and, therefore, Therefore, it would no longer be up to the case to be processed in a court of the jury – which judges crimes against life.

According to a Civil Police investigation into the case, five days after the attack on the production company Portas dos Fundos, Fauzi was identified by security cameras as one of those responsible for throwing Molotov cocktails (explosive artifact made with a bottle of gasoline and a wick lit) on the facade of the producer.

The action would be a reprisal for the producer’s Christmas special that portrayed Jesus as gay. The production company’s security worked at the scene at the time of the attack. He managed to contain the flames and escaped unharmed.

Five days later, Fauzi’s identification was obtained by the Civil Police of Rio de Janeiro and he was arrested, but he had already fled to Russia.

After the attack on the production company, the police seized, at Fauzi’s house and at two other addresses linked to him, R$119,000, two toy guns, knives, and a shirt from an association that claims to be nationalist.

The International Criminal Police Organization (Interpol) issued an arrest warrant. Fauzi was detained by Interpol in Moscow in September 2020, where he remained until Russian courts authorized his extradition in January of that year.

The economist arrived in Brazil on March 3 and was escorted by federal police on a flight from Moscow’s Vnukovo International Airport to Rio.
