The player Neymar will not have to pay the fine of R$16 million for the construction of an artificial lake in the house he owns in a luxury condominium in Mangaratiba, on Costa Verde, in Rio de Janeiro. The Rio Court annulled, this Monday (8), the assessment because it understood that there was no need for an environmental license for the work.
Judge Adriana Ramos de Mello's decision also cites a report from the State Environmental Institute (Inea) that found no environmental damage due to construction, during an inspection of the property.
The fine was related to carrying out work subject to environmental control without authorization (R$ 10 million); land movement without authorization (R$ 5 million); non-compliance with the imposed embargo, as the player dived into the lake after it was closed (R$ 1 million) and removal of vegetation without authorization (R$ 10 thousand).
According to the Inea document cited by the judge, however, no irregular capture of river water was found; no earthmoving or earthmoving was necessary to build the lake, since the land was already flat; nor drastic cutting of vegetation; among other points.
Therefore, the fine would not be applicable. “The danger of delay is well-known, since the fines were applied in million-dollar figures, so that maintaining their enforceability, in the current evidentiary context, will inflict substantial, disproportionate and even illegal harm to the aggravating party, given Inea's statement. ”, concludes the judge.

Work on Neymar's mansion in Mangaratiba, Rio de Janeiro, was banned in June last year, in a joint action between the city of Mangaratiba and the Military Environmental Police, the Civil Police and agents from the Environmental Protection Group. The action was carried out after complaints on social media that showed major work without environmental authorization in the player's mansion.
According to the City Hall, several environmental infractions were discovered by the team, such as diversion of water courses, taking water from a river without authorization, taking water for an artificial lake, earthworks, excavations, moving stones and rocks without authorization and applying sand from beach without environmental authorization. However, even though it was banned, Neymar inaugurated the work and even dived into the lake.
Initially, Mangaratiba City Hall had informed that the fine would be R$5 million, but the amount was increased to R$16 million due to the seriousness of the environmental infractions. The city's attorney general, Juraciara Souza Mendes da Silva, determined the amounts of the fines after analyzing the inspection report carried out by the environmental inspection team with the help of specialized professionals, such as engineers, biologists and oceanographers.
