Even after forming a majority of votes, the Minister of the Federal Supreme Court (STF) Rosa Weber asked to see, more time to analyze, the process that discusses labor rights involving Petrobras employees. This action is considered the largest ever faced by the state-owned company, with an impact of at least R$ 47 billion.
The process refers to the request by Petrobras employees to incorporate into the fixed salary, the remuneration calculation agreed in a 2007 collective agreement, called Minimum Remuneration by Level and Regime (RMNR), and which had been applied by the company.
The action had already been judged by the Superior Labor Court (TST), which considered Petrobras’ calculation to be irregular.
Minister Alexandre de Moraes, rapporteur of the case, suspended the conviction of the TST in July 2021 and understood that there would be an important financial impact on Petrobras.
“From an economic point of view, only the plaintiff in this specific case (a state-owned employee) understands that he received a third of the amount effectively due. In a single month, about ten years ago, R$ 2,000 was paid to the minor. Considering the thousands of ongoing actions, the company’s liability projections are credible, in the event of failure in this controversy,” said the minister in the vote.
The trial took place in the virtual plenary of the First Class of the STF until this Friday (18), where ministers cast their votes in the Court system without the need for face-to-face discussion. Ministers Dias Toffoli and Cármen Lúcia followed Moraes. Minister Luís Roberto Barroso declared himself impeded. Now, Minister Rosa Weber has no deadline to return the process and the trial to be resumed.
