Minister Rosa Weber, of the Federal Supreme Court (STF), will be the rapporteur of the action presented on Thursday (13) by the Brazilian Bar Association (OAB), Association of Magistrates of Brazil (AMB), among other entities, against the constitutional amendment created from the PEC dos Precatórios.
According to the OAB, the action was presented because the amendment “violates fundamental rights and guarantees to the conformation of the Principle of Separation of Powers and to the Democratic State of Law itself”.
“EC 114/2021, by establishing an undue limitation on the payment of the amount recognized as due by the Judiciary, represents an unequivocal violation of the constitutional principle of separation of powers (art 2, CF) which ensures not only the independence and harmony between the Powers , but, above all, the protection of individuals against the potential abuse of an absolute power”, states another point of the justification.
The distribution of the case to the minister occurred because she was already the rapporteur of a similar process, a lawsuit filed by the PDT last year against the PEC.
