Santander and Safra file lawsuits against Americanas

Banco Safra and Santander filed lawsuits against Americanas, after the company filed for bankruptcy last week, with debts of R$ 43 billion involving financial, labor and supplier creditors. The request came days after the announcement of an unforeseen billionaire shortfall in its balance sheet.

According to the Rio de Janeiro Court of Justice, Banco Safra requested a suspensive effect against the court-supervised reorganization decision requested by Americanas and accepted by the Court.

Santander, on the other hand, filed a lawsuit against the company at the São Paulo Court of Justice, which stated to the CNN being under analysis, but did not give details about the process because it is secret from Justice.

Like Bradesco, Itaú, BTG Pactual, Banco do Brasil and other financial institutions, the two banks are exposed to the risk of default by Americanas. This scenario is the background of recent fights between the company and its creditors.

BTG led this queue for being among the hardest hit by the company’s spills. On the last 18th, the bank managed to reverse part of the effects of the decision taken by the Justice of Rio that was favorable to the retailer and determined the return of R$ 1.2 billion paid to the financial institution.

Afterwards, Bradesco announced that it asked the Justice of Rio de Janeiro to only allow Americanas to withdraw funds from the bank with prior approval.

According to the retailer, the “unilateral attitude of creditor banks against the company’s cash jeopardizes its viability. Only Banco Bradesco withheld more than R$ 450 million from cash, acting in disagreement with the decision of the injunction”.

The company also said, in a note, that “it continues to seek a short-term solution with its creditors, to maintain its commitment as a generator of thousands of direct and indirect jobs, broad social impact, a source of production and a stimulus to economic activity. , in addition to being a relevant tax payer. Americanas hopes that creditors will also commit to finding solutions.”
