Judge Kismara Brustolin, investigated for shouting reprimanding a witness and calling the man “mouthy” during a hearing at the Regional Labor Court of the 12th Region, asked to be removed from office this Wednesday (29).
A CNN judge Elton Sales, president of Anamatra 12 – Association of Labor Justice Magistrates of Santa Catarina, confirmed that the judge was removed for mental health reasons.
An irregularity investigation procedure was initiated by the Regional Inspectorate to investigate the facts. The body will be responsible for determining whether any mental disorder was the motivator for the judge’s conduct.
According to the Regional Labor Court (TRT), the Presidency and the Regional Inspectorate decided to immediately suspend the hearings held by the magistrate. Kismara Brustolin will not comment on what happened.
Remember the case
During a labor hearing, judge Kismara Brustolin, shouting, reprimanded a lawyer who called her a doctor, stating that he would have to respond with “what do you want, Your Excellency?”
At a certain point during the hearing, the judge interrupts the man, calling him “mouthy”.
The case was recorded and released earlier this week.
In a statement, the OAB stated that substitute judge Kismara Brustolin displayed aggressive attitudes and behavior towards lawyers, parties and witnesses and requested urgent measures to investigate what happened.
The National Council of Justice (CNJ) will also investigate the judge’s conduct.
