THE President of the Supreme Federal Court (STF), Minister Luís Roberto Barroso, approved on Thursday (8), a Military Police . The decision ended a judicial dispute that originated in a request for suspension of injunction filed by the Public Defender’s Office of the State of São Paulo.

The request of the Public Defender’s Office contested a previous decision of the President of the São Paulo State Court of Justice, who had supported the obligation to use body cameras in operations carried out in response to attacks against military police.
After three conciliation hearings conducted by the STF Consensual Conflict Solution Center (nusol), the parties reached a consensual solution. The agreement was then approved by Minister Barroso, resulting in the extinction of the case in the Supreme Court and the related public civil action that was being processed at the 11th Public Finance Court of the Capital.
Understand what changes
The approved agreement establishes a series of commitments to the State of São Paulo, aiming at the expansion and improvement of the use of Portable Operational Cameras (COPs) by the Military Police. The main changes include Equipment increase and allocation, increased and allocation of equipment, priority in troop displacement, new technologies, training and standards, administrative processes, transparency and monitoring.
The State will enter into an additive term to the existing contract with the company Motorola to increase the number of body cameras by 25% reaching a total of 15,000 equipment . Of these, 80% will be allocated to fully cover high and medium priority police units .
The mandatory use of COPs applies, provided that in regions with available equipment, in large operations or incursions in vulnerable communities, when intended for the restoration of public order . It is under the responsibility of state administration the training on the proper use of cameras. Upon 60 days After the approval, a new standard with guidelines and operating procedures will be edited by the Military Police. This standard should:
- Ensure its adequacy to the new technological and operational standard
- Structure a robust and effective disciplinary system.
- Encourage effective monitoring, supervision and auditing mechanisms for the use of cameras.
- Clearly define the circumstances of mandatory use.
- Specify rules for each activation mode (manual, remote-intensional, remote-automatic).
- Expressly predicts that triggering, keeping activated and not interrupting the recordings is a police-military duty for disciplinary purposes.
- Fix guidelines for the characterization of violations related to the use of cameras.
- Define storage procedures, preservation and integrity of recordings, including security rules and data access.
- Define continuous monitoring and supervision procedures, including immediate communication of irregularities.
- Update the random video review procedure by superiors.
- Consolidate, revise and revoke previous standards for uniformity
The agreement, which was attended by the Public Defender’s Office, State of São Paulo, Attorney General’s Office, Public Prosecutor of the State of São Paulo and Observers, represents the regulation and expansion of the use of body cameras by the São Paulo Military Police, seeking to increase transparency.
