Senate approves PEC that provides for IPTU discount to environmentally sustainable properties

The plenary of the Senate unanimously approved, this Tuesday (13), a Proposal for an Amendment to the Constitution (PEC) that provides for the granting of a discount on the Tax on Property and Urban Territorial Property (IPTU) to environmentally sustainable properties.

The intention is to establish environmental criteria to reduce the IPTU rate to be paid by urban property owners who adopt sustainable ecological measures. The PEC was approved in two rounds on the Senate floor and is now going to be analyzed by the Chamber of Deputies.

According to the proposal, the IPTU calculation will disregard the portion of the property where there is native vegetation.

Still according to the text, municipalities will be authorized, but not obliged, to apply different IPTU rates according to:

  • use of rainwater;
  • reuse of wastewater;
  • on-site wastewater treatment;
  • aquifer recharge;
  • use of green roofs;
  • degree of soil permeability;
  • use of renewable energy.

“It is expected that the explanation of environmental criteria in the Federal Constitution will increase popular pressure for its adoption at the municipal level”, wrote the rapporteur of the text in the Senate plenary, Eliziane Gama (Cidadania-MA).

The PEC was originally presented by Senator Plínio Valério (PSDB-AM).

The IPTU exemption relating to the area of ​​the property with native vegetation will be applied 180 days after the entry into force of the PEC, when enacted, so that there is time for the municipalities to regulate the matter.
