Senate approves text that limits readjustment of occupation rates on Union land

The Senate plenary approved, this Tuesday (25), a bill that limits the readjustment of forum and occupation fees of Union lands. The text was approved with changes in relation to the original provisional measure edited by the Executive in June of this year.

The matter had already been approved by the Chamber of Deputies this month and now goes to presidential sanction.

By the text, the readjustment of the occupation rates of land of the Union is limited to 10.06% until the end of 2022. As of 2023, the maximum percentage will be twice the accumulated variation of the National Broad Consumer Price Index ( IPCA) of the previous year or 10.06%, whichever is lower.

The rapporteur of the text, Senator Carlos Portinho (PL-RJ), leader of the government in the Senate, said that, until the entry into force of the MP, the percentage of updating would be, at most, five times the accumulated variation of the IPCA for the year. prior to the collection, applied on the amounts charged in the previous year, except for the correction of registration inconsistencies or the existence of a valid valuation of the property. Therefore, in practice, he said, the maximum readjustment could reach just over 50% because of the high inflation and the lag between the value plants practiced in the Union.

A period of 60 days is established for the regularization of the cadastral registration with the Secretary of Coordination and Governance of the Patrimony of the Union for transfers, onerous or not. It also seeks to facilitate the acquisition of non-operating properties of the extinct Federal Railroad Network (RFFSA) by people who have occupied these properties for more than 17 years and to allow that in the sale of properties registered in occupation, used as housing by the current occupants, the evaluation by values ​​plan of the Union Heritage Secretariat (SPU) is allowed.

The text also deals with points to reduce the bureaucracy of the real estate appraisal process, update rules for the disposal of registered Union properties and allow federal agencies, foundations and public companies to donate to the Union unusable properties that are not being used in their operational activities. .

In addition, it allows the direct sale of federal property to holders of assignment of use contracts, who are up to date with contractual obligations.
