Serbia: Referendum on Constitutional Review to Ensure Independence of Justice

A referendum on the revision of the Constitution is being held today, Sunday (16/1) in Serbia. 6,510,323 citizens have the right to vote and they are called to the polls to answer yes or no to the question “Are you in favor of the ratification of a legislative act for the revision of the Constitution of the Republic of Serbia?”.

The election process started at 7:00 am when 8,179 polling stations opened and so far it is running smoothly. Kosovo Serbs, according to the Athens News Agency, will exercise their right to vote in Central Serbia, given that the government in Pristina did not allow the referendum to take place in Kosovo.

The revision of the Constitution will take place if it is voted in by the majority of voters

The polls will remain open until eight in the evening. His success referendum does not depend on turnout, ie there is no minimum number of voters who must go to the polls. The result is binding and the revision of the Constitution will take place if it is voted in by the majority of voters.

The revision of the Constitution concerns the rule of law and in particular the election of judges and prosecutors to ensure the independence of the judiciary. These amendments were approved by the Venice Commission of the Council of Europe. The EU, in the process of accession negotiations with Serbia, also called for a revision of the Constitution with changes that would guarantee the independence of the judiciary.
