Signing of contracts up to 31.5 based on engineer certificates up to 31.3, POMIDA and notaries request

The presidents of real estate owners, Mr. Stratos Paradias and the notaries Mr. George Rouskas, in order to give to the citizens who could not complete their real transactions until 31.3.2022 due to the workload of the state services, the possibility of drawing up real estate transfer contracts until 31.5.2022 based on engineering certificates that had been legally issued until 31.3.2022.

In particular, in their letter to the Ministers of Environment and Energy Costas Skrekas, Minister of State George Gerapetritis, Deputy Minister of Environment and Energy Nikos Tagaras, the general secretary H.S. and Urban Environment Efthymios Bakogiannis and the President of TEE Mr. George Stasinos, POMIDA and the Coordinating Committee of Notarial Associations of Greece (SESSE) reports:

“The harsh reality experienced today by a large number of property owners across the country (approximately 15-20,000), forces us to return for the last time, of course, to the subject of this letter.

The problem of all this is that while they had legally issued until 31.3.2022 engineers’ certificates for drafting real estate transfer, parental benefit, donation, establishment or modification of horizontal property, and had issued a bunch of other plans, certificates, certificates, etc., it did not may sign the relevant notarial contracts because due to the known workload of this period, they had not received until 31.3.2022 certificates of non-debt ARF from the relevant Municipalities, or certified tax returns, parental benefit or donation, etc. from the competent D .Ο.Υ. , which they had requested in due time.

Because it is completely unfair but also counterproductive, due to this delay, those parties who paid for the issuance of the engineering certificate, to be obliged to pay again for the issuance of “electronic building ID” which in addition to the additional financial cost will cost significant time delay but also inconvenience to find the pile of required documents, not counting the most common case of non-existence of relevant documents and plans in the competent planning service, events that can lead to the cancellation of a large number of these legal acts.

For these reasons we ask that the citizens who could not complete their real transactions by 31.3.2022 due to the workload of the state services be given the opportunity to draw up real estate transfer contracts until 31.5.2022 based on engineer’s certificates that had been legally issued until on 31.3.2022 ”.
