South Korean president’s party leader says Martial Law is “wrong”

The head of the South Korean president’s own political party condemned the declaration of martial law in the Asian country.

Han Dong-hoon, former justice minister under President Yoon Suk Yeol, said the move is “wrong” and that he would “block” it along with opposition lawmakers, according to Yonhap News Agency.

What is Martial Law?

Martial Law is adopted in “exceptional” situations, such as the outbreak of a war or in the case of natural disasters and catastrophes, for example. It allows, among other things, authorities to restrict movement and establish curfews, confining people to their homes.

The Brazilian Chamber of Deputies portal defines it as something that “subjects, during a state of war, all people to a special regime, with the suspension of civil and political guarantees, guaranteed, in normal times, by constitutional laws”.

The measure was declared, for example, by Russia and Ukraine when war between the countries broke out.

In an interview with CNN in February 2022, Camilo Onoda Caldas, post-doctor in Democracy and Human Rights at the University of Coimbra and director of the Luiz Gama institute, reiterated that Martial Law consists of an exceptional measure, provided for in the legislation of several countries and which aims to guarantee the country’s internal order.

“In general, it is an act that comes from the Executive Branch, which may require authorization from the Legislative Branch, and its main effect is the partial restriction of some fundamental rights of the country’s citizens and the submission of citizens to military authorities”, he explains.

“This does not mean that state authorities can do whatever they want with their citizens. Abuses can be punished and an essential part of citizens’ rights remain inviolable,” he added.
