SP condominiums must report cases of animal abuse to the police

The governor of São Paulo, João Doria (PSDB), enacted, this Friday (17), a law that requires condominiums in the state to notify police authorities of cases of abuse of animals.

Now, the Executive of São Paulo has 30 days to regulate the law.

Enacted in the Official Gazette of the State of São Paulo this Friday, the law indicates that the administrators or administrators of residential and commercial condominiums are responsible for communicating to public security agencies.

If the incident is still ongoing, the police must be notified immediately through a phone call or cell phone application.

In cases where the occurrence of mistreatment of animals has already happened, the communication must be made within 24 hours – using the portal of the Electronic Animal Protection Police (DEPA), or at any Civil Police Station in the municipality.

“The communication must contain the greatest possible amount of information about the case, such as: identification and contact of tutors; qualification of the animal, informing the species, breed or physical characteristics that allow its identification; address where the animal and guardians can be located; detailing the signs or evidence of the occurrence of maltreatment; among others”, determines the law.

Condominiums are also required to place posters, signs or notices in common use areas publicizing the law.

The project, authored by deputy Bruno Ganem (Podemos), was approved by the Legislative Assembly of São Paulo (Alesp) on November 17th.

The text approved by the deputies provided for the imposition of a fine in case of “inertia or omission on the part of the trustee or administrator” when making the complaint. The penalty would be 200 times the value of the Fiscal Unit of the State of São Paulo (UFESP), which currently corresponds to R$5,818.

Failure to comply with the obligation to affix a poster, plaque or notice in the condominium’s common areas would result in a fine of 50 times the value of UFESP, equivalent to R$ 1,454.

All articles that provided for penalties were vetoed by Governor João Doria (PSDB) when enacting the law.
