The change in the civil registry of non-binary people was authorized by the Court of Justice of São Paulo.
Non-binary basically refers to people who do not identify fully as male or female.
With the new decision, the terms agender, non-binary, and/or unspecified may be included in the “sex” field of the civil registry.
Judge Viviani Nicolau, rapporteur of the appeal, stated that the inconsistency between registered sex and gender identity is a discriminatory factor that reinforces structural prejudices in society.
“The suffering to which a person who is not recognized by society according to their gender identity is subjected is undeniable,” added the judge.
International Non-Binary Persons Day is celebrated on July 14. The date aims to give more visibility and understanding to this identity.
Legally, gender identity is an individual’s internal experience of gender, which may or may not correspond to the sex assigned at birth.
Gender identity is different from sexual orientation. Sexual orientation refers to emotional and sexual attraction, whether a person is attracted to men or women, for example.
Gender identity concerns a person’s self-identification, how they see themselves and how they want to be understood by society in relation to their gender.
