SP government is sentenced to compensate a student after a racist speech of a teacher

The São Paulo Court of Justice (TJSP) ordered the state government to pay a compensation of R $ 10,000 for moral damages to a student who was the victim of racism at Pedro Roberto Vaghi State School in Guarulhos, in the metropolitan region of São Paulo, in June 2023. The aggressions came from a teacher of the teaching unit.

According to testimonials from witnesses and the victim herself, the teacher referred to the student with phrases such as “he looks like macumba pipe” and “I don’t go to the beach so as not to be black like him.”

The offenses were spoken in front of classmates at a time when the boy had been taken to the board for talking in inappropriate time during class.

On another occasion, the teacher stated that all students at the school were “black, poor and dumb.”

The rapporteur of the case, Judge Eduardo Prataviera, stressed that the fact had special gravity precisely because he was committed by a teacher, figure of authority and reference in the formation of the students.

“The school environment must be a receptive, learning and respectful space, and the teacher’s act to make racist comments and injuries directed at one of the students not only hurts the dignity of the victim, but also shakes confidence in the state education and acting of the state, which has a duty to ensure a free education of discrimination. Prejudice in a context that should fight it, ”said Prataviera.
