The courts ordered the state of São Paulo to pay R$50,000 to Vanes de Jesus da Silva, 47, following a medical error. While undergoing treatment for kidney failure, the man underwent a procedure and had a guide wire left between the jugular and the right atrium of the heart.
The error was discovered during a chest X-ray, when a Permcath catheter guide wire was discovered lodged in the body of the man who suffers from diabetes.
The intervention was carried out by the Unified Health System (SUS), through a partnership with the Segumed Institute, in São Vicente (SP).
A court injunction in 2023 ensured that the state would take over the surgery to remove the instrument, forgotten in 2022. The State Treasury was notified on January 2, 2024, with a 15-day deadline to grant the surgery.
In a note, the State Department of Health (SES) reports that the removal was carried out on March 20 of this year, more than 60 years after the court order.
Check out the note: The Regional Health Department (DRS) of Baixada Santista informs that the catheter removal procedure is not performed in the region’s hospitals, due to the level of complexity of the intervention. For this reason, the removal of the catheter from patient VJS was performed at the Dante Pazzanese Institute of Cardiology, on March 20 of this year.
The defense of the self-employed, in a statement sent to CNN informed that “His lawyers also state that, given all the suffering experienced by Mr. Vanes, they will file a lawsuit for compensation so that he is compensated for the moral damages caused to him.”, the note states.
