State of SP is ordered to pay 100 minimum wages to motorcycle courier attacked by PM

The São Paulo Court of Justice (TJ-SP) ordered the state to pay 100 minimum wages, equivalent to more than R$140,000, to André Andrade Mezzette, a motorcycle courier attacked and accused of robbery by a police officer in 2020.

The determination by the 4th Public Finance Court occurred after a reanalysis of the case in August 2024. The court assessed it as serious conduct by the police officer and the responsibility of the state.

André will receive compensation for moral damages of 100 minimum wages, which at the current value, is equivalent to R$ 1,412, in addition to 15% fees on the value of the conviction for the Public Defender’s Office, responsible for defending the motorcycle courier.

The case occurred on Rua do Capinzal, in the Furnas neighborhood, in the north of São Paulo, in August 2020. André was verbally and physically attacked with punches and kicks after being approached by an off-duty police officer while working as a delivery man for a pizzeria.

During the approach, the agent was armed and allegedly intimidated the victim by asking “if he was a thief”.

The Military Police were called and the victim was taken to UPA-Jaçaña due to his injuries. The 73rd DP ordered André’s preventive detention after the police officer formally accused him of robbery.

At the time, images were released that showed the accused cornered and surrendered while being attacked by the police officer. André was then released and the Public Prosecutor’s Office asked for the investigation to be closed.

The Attorney General of the State of São Paulo informed the CNN who will appeal the decision.
