State tax waiver on fuel reaches R$18.2 billion, says Comsefaz

Brazilian states failed to collect BRL 18.9 billion with the freezing of the Tax on the Circulation of Goods and Services (ICMS), since November 2022.

The projection was announced by the National Committee of Secretaries of Finance of the States of the Federal District (Comsefaz), a day after Petrobras announced an 8.8% increase in the cost of a liter of diesel in refineries.

With the increase announced by the state-owned company, the average cost of a liter of diesel goes from R$ 4.51 to R$ 4.91 as of this Tuesday (10), after 60 days without adjustment. The lag already reached 25%, according to an estimate by the Brazilian Association of Fuel Importers (Abicom).

The ICMS freeze, by the states, began in November 2021 and is expected to extend until June 30 this year.

In a position released to the press, Comsefaz informs that “the efforts of state budgets, as has always been explained by the states, are not effective against the escalation of prices in the International Parity Policy (PPI) system and still sacrifices the financing of public services. mainly used by the poorest population.

A meeting between the state finance secretaries and the president of the Federal Senate, Rodrigo Pacheco (PSD-MG), is scheduled for Thursday (122). The objective is to show the efforts to regulate Complementary Law nº 192/2022, which changed the ICMS taxation model levied on fuels.

On March 24, the secretaries approved the so-called “ICMS Agreement”, at a meeting of the National Council for Finance Policy (Confaz), which established a state rate with a fixed standard cost per liter of S-10 diesel. The stipulated amount was BRL 1.0060, calculated with a reference value from November 2021. The measure does not prevent states and the Federal District from applying subsidies.

On this occasion, the freezing of ICMS by the federation units was extended. Thus, the forecast is that the new rules will be implemented only after the agreement expires, as of July 1st.
