Critics of the new Tax on the Circulation of Goods and Services (ICMS) fixed on fuel, State Finance Secretaries decided on Monday (14) how to apply the rule, which is already in force, while they seek a decision from the Court to overturn the text.
The National Committee of Secretaries of Finance of the States and the Federal District (Comsefaz) and the collegiate of state attorneys, responsible for actions by local governments in the courts, started conversations about the action that the States will take in the Federal Supreme Court.
The governor of Piauí, Welington Dias, who heads the Northeast Consortium, told CNN Brazil that the law enforcement modeling was approved and the legal team was also given more days to align the thesis against the new rule.
According to the law, until the States set the ICMS rate, the charge on the average price of diesel for the last five years will apply. “We have to follow the law and the main thing is the five-year average rule”, said the governor. The States estimate that there will be a loss of R$ 17 billion to the coffers.
Therefore, they intend to point out in court that the law has unconstitutional parts. Among the arguments, they will tell the STF that they see a lack of study on the new rule, conflict of jurisdiction and electoral crime.
