The state finance secretaries approved this Thursday (24) the “ICMS Agreement”, which regulates the collection of the tax for diesel oil. The proposal creates a rate with a standard fixed cost per liter and extends the freeze on the state tax on gasoline, ethanol and cooking gas for another 90 days. Thus, the measure remains in force until June 30.
The decision was taken at an extraordinary meeting of the National Council for Finance Policy (Confaz). Under the agreement, the state rate for the liter of S10 diesel oil, the most widespread in the country at the moment, was set at a ceiling of R$ 1.0060, calculated using the reference value of November last year.
The measure, however, allows the states and the Federal District to apply subsidies, so that there are no intense changes in relation to the parameters already adopted at the regional level.
For example, the state of Sergipe will apply an adjustment subsidy of BRL 0.0945 to the uniform rate, which, in practice, will result in a charge of BRL 0.9115 per liter of S10 for the state, that is, the same context of taxation in force today, according to Consefaz.
The adoption of the rate disciplines the complementary law 192/2022, approved by the National Congress and sanctioned by President Jair Bolsonaro (PL). The rule understood that the different state rates, established as a percentage, were responsible for the rise in fuel prices.
In the new format, with a financial tax fixed in currency per litre, the cost will be maintained regardless of commercial fluctuations in the price of fuel. Even if the price of diesel increases, as a result of an eventual appreciation in the international market or a possible devaluation of the real, the states will not collect more with the increase in cost, as was the case with the tax defined as a percentage.
According to the National Committee of Finance Secretaries of the Federal District (Consefaz), the ICMS freeze has already reduced by R$ 1 billion per month the volume of resources from ICMS on fuel for the states until February. The municipalities, which receive a portion of the tribute, lost R$ 250 million.
With the current parameters, the projection is that the losses, as of March, represent R$ 1.15 billion for each unit of the federation.
