The Santa Catarina Civil Police indicted for manslaughter – when there is no intention to kill – the stepmother of the 3 -year -old boy who died after being forgotten for 10 hours in a car in Videira, in the west of the state.
The inquiry was concluded by the Child, Adolescent, Woman and Elderly Protection Police Station (DPCami) of the municipality. The woman will respond to the process in freedom.
The case occurred on April 25, 2025. According to the delegate Édipo Flamia Hellt, responsible for the investigation, the child was left in the car around 7 am and was only found at 5 pm, already lifeless.
The cause of death was asphyxiation. The body had no signs of external violence and was already in cadaverous rigidity when the firefighters arrived.
Images from security cameras and expert reports point out that the child was still moving inside the vehicle until around 9:05 – estimated time of death. The car report indicated misalignments and objects out of place, reinforcing that the child tried to move before he died.
Case
According to the stepmother’s testimony, it was a family routine that she left her mate at work and then take the boy to the day care. However, that day, he said he had forgotten the child, who was sleepy and with flu symptoms.
After parking the car at home, she locked the vehicle, took the bike and went to work in a neighboring town. Only in the late afternoon, when he returned to the car, he realized what had happened and triggered the firefighters.
The psychiatrist of the investigated, heard with permission of the patient herself, confirmed that she does treatment for anxiety disorder and attention deficit, using controlled medication. The investigation concluded that, even without intent, the stepmother’s conduct was negligent and there was objective predictability to the risk.
“The conduct was omissive and negligent. She already had a habit of making this path. It was not an isolated fact,” said the delegate. He also pointed out that technology can help prevent tragedies like this, mentioning that apps like Waze offer alerts to remember drivers of children on board.
With the closure of the investigation, the case was referred to the Public Prosecution Service, which may offer complaint, request new steps or file the process.
