The Federal Supreme Court (STF) begins, this Friday (29), a virtual trial to analyze the State’s responsibility for the deaths of civilians during police operations.
The action refers to a case from 2015, when Vanderlei Conceição de Albuquerque was hit by a gunshot, inside his own house, in Complexo da Maré, during an exchange of gunfire between criminals and Pacification Force agents.
The case’s rapporteur, Minister Edson Fachin, voted to condemn the Union and the State of Rio de Janeiro to pay compensation of R$200,000 to each of the victim’s parents and R$100,000 to his brother.
The minister is also in favor of reimbursing the victim’s funeral expenses and paying a lifetime pension to his family.
In previous instances, the family’s request had been denied, as there was no proof that the projectile that hit the resident came from a public agent. The family members appealed to the STF.
Fachin proposes the thesis that, without conclusive expertise, the State is responsible for casualties in public security operations.
In his vote, the minister pointed out that “from the report prepared by the Civil Police it is clear that the operation by Army soldiers triggered the exchange of fire. If the incursion by the Army Pacification Force had not occurred, there would have been no exchange of fire and, therefore, Vanderlei Conceição de Albuquerque would not have been murdered.”
A CNN contacted the Union and the Government of the State of Rio de Janeiro so that they could take a position on the case and is awaiting a response.
