The Minister of the Federal Supreme Court (STF) Ricardo Lewandowski authorized, this Wednesday (8), the government to suspend the reduction of the PIS/Cofins tax rate for companies, stipulated by means of a decree at the end of the previous government, signed by the then deputy -president, Hamilton Mourao.

The measure would come into force in January 2022, however, it was suspended by President Luiz Inácio Lula da Silva (PT) as soon as he took office this year and reestablished the total collection of the rate. As a result, companies appealed to the courts to request the validity of the previous government’s determination.
Minister Lewandowski understood that the current government is right to suspend the measure – accepting the argument about the impact on revenue – and even determined the suspension of judicial matters involving the case.
