The commission created by the Federal Supreme Court (STF) to seek conciliation between the federal government and states on the ICMS tax rate on fuel began work this Tuesday (2). The group left a pre-scheduled next meeting for August 16 and should be held in person at 2 pm at the Supreme Court.
On the occasion, the reasons for the reduction of ICMS on fuels operated through Complementary Laws 192 and 194/2022 were discussed, and whether the approved measures are temporary or permanent. For the next meeting, the states asked the Union to present some proposal after today’s discussions.
THE CNN found that minister Gilmar Mendes, rapporteur of an action on the subject, came to talk to another minister who is rapporteur of a similar action in the Court and decided that what is agreed will apply to all actions.
The assistant judge in the cabinet of Minister Gilmar Mendes, Diego Veras, stated that he has the role of facilitator of conversations and negotiations, through the use of mediation and conciliation techniques, when there is a need to adopt differentiated strategies, depending on the evolution of the discussions.
“Our role is to rebuild bridges and make them review positions that may have previously proved to be fruitless or inappropriate, whether from a constitutional or institutional-federative point of view,” said the magistrate.
Decio Padilha, president of the National Committee of Secretaries of the Treasury (Comsefaz), said that if it stays the way it is, the bankruptcy of what is called a federative pact will be decreed in the coming months.
The Deputy Special Secretary for Treasury and Budget at the Ministry of Economy, Julio Alexandre, said it is important to monitor the data to see the effects.
“The understanding of the Legislative Power is that there is enough cash in the state governments to help in this exceptional, difficult moment that we are living. If you look at the ICMS data, information that we have until June, an increase of R$ 48 billion. If you put in other state taxes, we have an even greater increase. states are increasing revenue,” he said.
The parties have already participated in a commission to seek an agreement under the supervision of Minister André Mendonça. The federal government and the states, however, did not reach a consensus.
In June, Gilmar also tried to hold a conciliation hearing on the case, but there was no decision on the occasion.
