The determination of the Federal Supreme Court to classify acts of homophobia and transphobia as a crime of racial injury is positive.
This is the vision of the president of the National Association of Transvestites and Transsexuals (ANTRA) Keila Simpson Sousa.
In practice, whoever is responsible for acts of this type will not be entitled to bail, nor will there be a time limit for responding in court.
A CNN Radio on CNN Plural, she explained that the decision “will in fact balance the understandings.”
This is because “the lower courts insisted on not squaring the crime of racial injury individually.”
“When they complied, it was with a form of racism aimed at collectives”, he explained.
However, Keila pointed out that most people who suffer from transphobia and LGBTphobia happen on an individual basis.
