STF forms a majority and maintains decision on basic income in the 2022 budget

The Federal Supreme Court (STF) formed a majority to uphold a Court decision that determined that the Bolsonaro government set the value of a national basic income from 2022.

The score, so far, is 9 votes to 0. According to the decision, the benefit should be paid to Brazilians in extreme poverty and should be included in next year’s Budget.

The ministers analyze an action on the case in the STF’s virtual plenary. In April, the STF determined the creation of basic income. The Union appealed and this appeal is under analysis.

The case’s rapporteur, Minister Gilmar Mendes, voted against the appeal presented. According to him, the “unconstitutional omission determined by the Judiciary, far from being framed in electoral opportunism or in the promotion of a possible candidacy (…) only achieves one of the objectives of the Federative Republic of Brazil”, which, according to the minister, is “eradicate poverty and marginalization and reduce social and regional inequalities”.

Gilmar’s understanding was followed by ministers Ricardo Lewandowski, Carmen Lúcia, Edson Fachin, Alexandre de Moraes, Dias Toffoli, Luiz Fux, Luís Roberto Barroso and Rosa Weber so far. The only one who did not vote is Nunes Marques. Votes can be entered until 23:59 this Monday (22) in the STF’s electronic system.
